you have to get the sample cleared... by whoever owns the song.

but you can give it out for demos if it's not cleared.

it doesnt matter if anybody is dead because the companies that own the publishing still live on

and even if they were to crumble, another company would buy their library or some how inherit it

    i digress...

the label or artist putting out the song would have to clear the sample
because you stand to make what? a couple hundred dollars? a couple thousand?

nobody is going to get sued by a major corporation for 500 dollars, it would cost them that much just getting to the court house.

and.... in all likeliness even the artist wont create enough of a buzz (or income) to garner their attention unless they get lucky with a certain indie or are backed by a major label

in short, you're not going to make enough money to get sued over, you'll be fine selling it for profit

(unless the riaa decides to sue you for sharing the file over the internet, in which case youre fucked.)

    They are no rules.

    sampling= limitless.

its just if u sell a beat to an artist who sells 10 000 copies then its there responsibility
to clear it and not yours.

as far as what type of shit to sample.

    50s-60s-70s-80s-90s-00s.

it dont matter as long as its hot.

You don't gotta get anything cleared.

the artist and or record company does.

Ok that makes a whole lot of sense....

You just basically selling your creativity & idea with the sample used....other words you built the foundation..and now someone wanna build something on it....

after that it up to the Customer to do what he wanna do with it...
